DATIA and SHRM Poll Show Pre-Employment Drug Testing On the Rise

The Society for Human Resource Management (SHRM) and the Drug and Alcohol Testing Industry Association (DATIA) released a poll this fall that showed the practice of requiring job applicants to take a pre-employment drug test appears to be gaining acceptance from employers.

The September 7, 2011 poll revealed that fifty-seven percent of the survey participants’ organizations require all job candidates to take a pre-employment drug test, while less than a third (29 percent) do not have a pre-employment drug-testing requirement. The remaining 14 percent of respondents test applicants for safety-sensitive positions and when required by state law.

The poll, which was commissioned by DATIA and conducted by SHRM, surveyed 1,058 randomly selected HR professionals and featured questions about employers’ drug-testing policies and practices.

School Van Driver Smelling of Alcohol Arrested before Picking up School Children

Pittsburgh's KDKA recently reported that an A.J. Myers and Sons bus company driver was recently arrested for intoxication prior to making his run to pick up Woodland Hills School District students. The driver stopped into Bishop’s Pizza in Turtle Creek, PA reeking of booze and responsible employees of the shop called police to report him when they realized that he was a school bus driver. Wilkins Township Police Officer Jon Sherman said, “They reported that a van driver, a school van driver, came into their business and he smelled of alcohol." The police took the driver to the hospital for an alcohol blood test and pending the results the driver could be facing DUI and other charges as well as possible recklessly endangerment.

The Association of Surfing Professionals to Begin Drug Testing Wave Riders in 2012

Since the 1960's the sport of surfing has always been surrounded by the negative bad boy image of partying, drugs and alcohol. The partying atmosphere has taken its toll on surfers throughout the generations leading to last years overdose death of surfing great Andy Irons. The Association of Surfing Professionals (ASP) will begin substance abuse testing next year in hopes of protecting their members and overall image. What type of drugs will be tested and what methods have yet to be determined. “It’s been a long time coming,” said Hawaiian event representative Randy Rarick. Details are vague, but the testing is expected to be in place for the Quiksilver Pro on the Gold Coast, the first event for 2012.

Persoff explained in a 2011 interview with ESPN that the Surfer's Code for Recovery is in addition to -- not a replacement for -- traditional recovery programs. "This is a way to translate traditional recovery programs into the surfer language," said Persoff. "I will watch out for other surfers. Surfers are a unique population, a tribe. Most of the education needs to come from within the tribe, like any cultural group," said Persoff. He takes surfers in recovery back out on the waves, and provides surfboards and gear, like Persoff's sponsor provided for him.

Drunk New Jersey School Bus Driver Turned In By Texting Students

New Jersey - Westampton Middle School students alerted parents that their bus driver seemed to be under the influence as erratic driving cause students to cry out "I don't want to die today!" The driver, Carole Crockett had a blood-alcohol level of 0.25 percent, five times the legal limit for operating a commercial vehicle. Crockett was released on $85,000 bail.

Chicago Loosening Grip on Possession of Small Amounts of Marijuana to Ease Budget Crunch

Cook County Commissioner John Fritchey told reporters that, "It is not time to act tough on crime; it is (time) to be smart on crime. We need our resources spent somewhere else."

Inexpensive Prescription Drugs Gateway to Heroin Use

“Prescription drugs are one of the things that get kids hooked” and lead them to begin abusing heroin, said Naperville police Detective Shaun Ferguson. “When they realize they can pay much less for heroin than for prescription drugs, they turn to heroin.”

Detective Shaun Ferguson — who works in his department’s Special Operations Group — concluded of all drug-related arrests made between 2009 and this year in Naperville, IL, approximately 34 percent involved heroin. That included 24 heroin-related arrests in 2009, 33 in 2010 and 28 so far this year. Prescription drug-related crimes are also on the rise from past years, Ferguson said, going from 13 such arrests in 2009 to 34 in 2010 and 18 to date this year.

The New York Times recently reported that Medicare is subsidizing drug abuse through allowing benefit receivers to search out doctors who will fill their prescriptions for large amounts of painkillers and narcotics. Congress says that this practice far exceeds what any patient could safely use. The General Accounting Office reported that 170,000 Medicare beneficiaries received prescriptions from 5 or more doctors for 14 types of drugs that are frequently abused.

The report states that the most commonly abused drugs by medicare recipients include the painkillers Oxcycodone and Hydrocodone (OxyContin and Percoset)

Georgia - a beneficiary received a 150 day supply of oxycodone in just 27 days by obtaining 7 different prescriptions from 4 different doctors.

California - a California man received over 1,300 fentaynyl patches and pills from 21 different prescribers in one year.

Bath Salts
The Drug Enforcement Administration recently temporarily banned certain chemicals that are used in legal synthetic drugs known as "bath salts", calling the chemicals an "imminent hazard" to the public. The DEA describes "bath salts", which have nothing in common with products long-used in bathing, as a sort of imitation cocaine or LSD – a substance that while legal, has not been approved by the FDA for human consumption and has been linked to violent, sometimes deadly outbursts by users. Varieties of "bath salts" are sold under different labels in corner stores across the U.S. as well as online and have prompted thousands of calls to Poison Control nationwide.

Drug Testing Deterrent - Employees Quit Rather Than Face the Music or Urine Cup!

Washington Closure Hanford, a radioactive waste disposal plant in Washington State has a zero tolerance substance abuse policy and recently showed why the policy is an effective deterrent.

Six workers at the site decided to quit rather than submit to drug testing after a baggie of marijuana was found in building at the landfill called the Environmental Restoration Disposal Facility.

A spokesman for the nuclear reservation contractor, Todd Nelson of Washington Closure stated to local media that managers found the baggie in the workers' day room Aug. 8 and immediately ordered drug tests for about 100 workers.

Six resigned rather than be tested. Results for 18 other employees are pending. All the rest of the tests were negative.

Cornell University: Substance Abuse Testing in the Workplace Reduces Injuries!

A recent Cornell University study claims that construction firms that utilize drug testing reduce workplace injuries.

Among the study's findings:

Construction companies that test for drugs may save substantially on their workers' compensation premiums. As a result of fewer job site accidents and injuries, the average drug-testing company in the study sample experienced an 11.41 percent reduction in its workers' compensation experience-rating modification factor. At the same time, companies in the study sample that did not employ drug testing saw no such decline.

Seventy-two percent of the respondents at companies with drug-testing programs in place said they believed the benefits of drug testing outweighed the costs.

The No. 1 reason why officials at the construction companies surveyed tested employees and job applicants for drugs was to promote worker and customer safety. Respondents believed that drug testing contributed positively to a company's image and was an effective deterrent to workplace drug abuse.

Suspected Methamphetamine Lab Shuts Down West Virginia School

A West Virginia Vo-Tech school has been temporarily shutdown after traces of methamphetamine were discovered throughout the building. The residue from the drug were found in the Principal's office, air ducts and bathrooms. The school's Principal and one of the teachers faces mutliple charges including manufacturing meth and procuring Sudafed for making meth and charges of purchasing over the legal limit of Sudafed.

Most of the methamphetamine abused in this country comes from foreign or domestic superlabs, although it can also be made in small, illegal laboratories, where its production endangers the people in the labs, neighbors, and the environment.

Summer Job-Site Heat Safety Measures

Mobile Medical Corporation (MMC) encourages all employees to practice Jobsite Heat Safety Measures! Here are some tips to help you endure the summer heat while on the job...

Avoiding The Heat!

The hottest part of the day is between 10 a.m. and 4 p.m.
If possible, work outside during the cooler times of the day.
Take frequent breaks in the shade, by a fan, or in air-conditioning.
Cool your skin by spraying water over your body.
Take a cool bath or shower 1 to 2 times a day in hot weather.

Eating & Drinking

Drink plenty of water before, during, and after you are active to ensure maximize hydration.
Drink 8 fl oz (250 mL) of water before being entering an active work cycle in the heat.
Continue to drink moderate amounts of fluid every 15 to 20 minutes during the activity.
Fluids such as rehydration drinks, juices, or water help replace lost fluids, especially if you sweat a lot.
Drinks, such as sports drinks, that have electrolytes work best. Drink rehydration drinks or sports drinks, which are absorbed as quickly as water but also replace sugar, sodium, and other nutrients.
Eat fruits and vegetables to replace nutrients.
DO NOT drink caffeine or alcohol. They increase blood flow to the skin and increase your risk of dehydration.

Other Helpful Tips

Stretching: If you have to stand for any length of time in a hot environment, flex your leg muscles often while standing. This prevents blood from pooling in your lower legs, which can lead to fainting. Wear support hose to stimulate circulation while standing for long periods of time to prevent swelling (heat edema).
Observe Urination: Urine should be clear to pale yellow, and there should be a large amount if you are drinking adequately. You should urinate every 2 to 4 hours during an activity when you are staying properly hydrated. If your urine output decreases, drink more fluids.

DEA Rules that Marijuana has No Acceptable Medical Uses

News wires such as the Atlantic Wire, Time and Infowars are ablaze with the recent announcement by the Federal Government that Marijuana has No Acceptable Medical Uses.

The Atlantic Wire Reports:
Nine years ago, supporters of medical marijuana asked the federal government to reclassify cannabis, which was listed as a Schedule I drug, the most restricted category of drug under the Controlled Substances Act in 1970. The petition asked the U.S. Drug Enforcement Administration (DEA) to take into account research showing marijuana's medical uses.

Two months ago, advocates asked the U.S. Court of Appeals to force the Obama administration to respond to their petition. Finally, in a decision published Friday, the DEA denied the request, ruling that marijuana has no accepted medical use and should remain classified as a highly dangerous drug like heroin.

DEA Administrator Michele M. Leonhart wrote that she rejected the request because marijuana, like other Schedule I drugs, "has a high potential for abuse," "has no currently accepted medical use in treatment in the United States," and "lacks accepted safety for use under medical supervision." She wrote that "At this time, the known risks of marijuana use have not been shown to be outweighed by specific benefits in well-controlled clinical trials that scientifically evaluate safety and efficacy."

Mobile Medical Corporation blogged in November that the Federal Court System has ruled that the Federal guidelines supersede the States when dealing with compassionate laws on marijuana use. The Supreme Court has ruled that employers and the government can prosecute in those states that have compassionate laws on marijuana use. Employers need not accommodate the state rule.

Indiana Passes Bill To Drug Test Unemployed Who Apply For Job Training

Indiana has just passed a bill that requires drug testing for the unemployed who partake in the state-funded job training programs. The state believes that the drug testing will save them money by eliminating those people who are not committed to finishing the training programs. The drug testing is aimed at filtering out those who the state deems a financial liability due to drug use. Workforce Development Commissioner Mark Everson said. "We want to help people who are motivated to get jobs. They can't get a job if they're using drugs."

Indiana is the first state to require drug testing of people seeking job training. Florida recently began testing welfare applicants in general on July 1, 2011. 30 other states are considering some sort of drug testing action.

Man Tries to Purchase Synthetic Marijuana with Fake Million Dollar Bill

A Sharpsville, Pennsylvania man tried to use a fake $1 million dollar bill to purchase a bag of synthetic marijuana known as "K-2" or "Spice" and in this case called "Space Cadet Flight Risk" at a local convenience store. He was caught by police and charged with theft by deception and retail theft.

The synthetic marijuana is a mixture of common herbs sprayed with synthetic chemicals that mirror the high of marijuana. So far, twelve states have banned the sale of Synthetic Marijuana - (Kansas, Georgia, Alabama, Tennessee, Missouri, Louisiana, Mississippi, Arkansas, Oregon, Illinois, Michigan, PA, and Kentucky). The American Association of Poison Control Centers reported that within the past year there have been over 500 cases of negative reactions to the still legal yet dangerous drug. This type of pot is included in recent a bill outlawing such substances that Pennsylvania's Governor Tom Corbett signed into law. The PA ban takes effect in August 2011.

Pennsylvania Next in Line to Ban Hallucinogenic Bath Salts

MMC applauds Governor Tom Corbett for recently passing a law to ban bath salts, salvia and synthetic cocaine. The ban will take effect 60 days from the signing of the bill. Dr. Neil Capretto at Gateway Rehabilitation Center siad, "It should be made illegal,” and added, “It’s just too potent, too dangerous of a hallucinogen. It would be like having LSD legal which is absurd in my opinion.”

Recent NCAA Drug Testing Analysis Shows Elevated Use of Marijuana

The NCAA recently published the results of their annual drug testing analysis and the the number of college athletes testing positive for marijuana at postseason events was up nearly three times compared to their last survey. The number of positive marijuana tests across all three divisions increased from 28 in 2008-09 to 71 in 2009-10. College athletes are subject to NCAA-mandated drug testing for marijuana at NCAA championship events and football bowl games only. The current NCAA-testing policy requires that athletes testing positive sit out one full season and lose a year of eligibility.

Travis Tygart, CEO of the U.S. Anti-Doping Agency said, With medical marijuana use on the rise and increased calls in some states for legalization of the drug, more positive tests for athletes are not surprising." Tygart continued "It's a fear we've had that as marijuana and even some performance-enhancing drugs become more socially acceptable that athletes will think it might be acceptable within sports."

Florida vs. ACLU over Mandatory Public Employee Drug Testing

A recent lawsuit filed by the ACLU in Florida federal court recently challenged Florida Governor Rick Scott’s Executive Order mandating pre-employment and random drug testing for all Florida public-sector employees.

Matthew F. Nieman of the the Institute for a Drug-Free Workplace writes in a brief that despite the Executive Order’s express limitation to drug-testing, Howard Simon, executive director of the ACLU of Florida, was quoted by the AP in support of the suit, as stating “The analysis of urine also tells a lot more about you that is nobody's business,”including whether an employee is pregnant, or taking heart, diabetes, depression or other medications.

Nieman concludes, "The continuing misperception that an employment-related drug testing delves into pregnancy or diabetes is disappointing and confuses the pertinent issues. Nonetheless, private sector employees should note that a Fourth Amendment attack is applicable only to public-sector.

Florida Gov Signs Welfare Drug-Screen Measure; Takes Action Against Hallucinogenic "Bath Salts"

Welfare Drug-Screen Measure
Florida Governor Rick Scott signed legislation that would require adults who apply for welfare assistance to be drug tested. Scott lead with,"It is unfair for Florida taxpayers to subsidize drug addiction." The Governor hammered his point home by stating, "It's the right thing for citizens of this state that need public assistance and we don't want to waste tax dollars and we want to give people an incentive to not use drugs."

The Law will be in place on July 1, 2011. The legislation will require the Florida Department of Children and Family Services to drug test adults applying to the federal Temporary Assistance for Needy Families program. The adult who applies for assistance will be responsible for the cost but would recoup in their assistance if they qualify. Those who fail the required drug testing may designate another individual to receive the benefits on behalf of their children.

Banning of Hallucinogenic Designer Drug "Bath Salts"
Governor Scott also signed a measure outlawing hallucinogenic designer drugs known as "bath salts." Scott said, "The chemical substances found in 'bath salts' constitute a significant threat to health and public safety," Scott's office stated that the "Poison control centers in Florida have reported 61 calls of 'bath salts' abuse, making Florida the state with the second-highest volume of calls." The governors office offered that "The drugs are readily available at convenience stores, discount tobacco outlets, gas stations, pawnshops, tattoo parlors, and truck stops, among other locations."

Nuke Plant Operator Suspended For Failing Drug Test

A southeastern Michigan nuclear power plant operator recently failed his random drug test and was suspended for at least 14 days under federal rules for nuclear plants. Federal rules require nuclear plant workers to be tested randomly for drugs and alcohol. Nuclear Regulatory Commission (NRC) spokeswoman Viktoria Mitlyng hinted that the owner - DTE Energy will decide whether to fire the employee or refer him to a program for substance abuse treatment and evaluation. A reactor employee who fails a drug test twice will have access to any nuclear plant revoked for at least five years.

Fairytale Drug Operation Supplied Cape May, New Jersey Prison

The Cape May County Correctional Center recently broken up a "fairytale" drug trafficking operation that used children’s coloring books featuring Cinderella and Snow White to smuggle drugs into jail. The operation used a dissolved solution of narcotics which was made into a paste and then painted onto the coloring book pages and mailed to the inmates. The coloring pages, seemed like an innocent correspondent and were even addressed "to Daddy" and signed "from Emma Lee." The authorities were tipped off on the operation and shut it down.

The main drug in the paste was Suboxone. Suboxone is used to treat opioid addiction and contains a combination of buprenorphine and naloxone. Buprenorphine is an opioid medication. Buprenorphine is similar to other opioids such as morphine, codeine, and heroin. Naloxone blocks the effects of opioids such as morphine, codeine, and heroin.

Synthetic Marijuana Popular Among Nation's Youth

In December MMC blogged about the rise of syntehtic marijuana known as "K-2" or "Spice" among the nation's youth. The synthetic marijuana is a mixture of common herbs sprayed with synthetic chemicals that mirror the high of marijuana. Smoking the synthetic marijuana does not result in a positive drug test. A recent report out of Iowa sheds more light on the dangers of "K2" and how little the public still knows about the substance. 18 year old David Rozga had apparently been smoking the synthetic marijuana prior to his own suicide. David's father believes that K2 led to his son’s death. Indianola police chief, Steve Bonnett, had commented on the incident by saying, "David had a severe panic attack after smoking K2, which resulted in his death.”

The synthetic product is sold as incense in head shops, tobacco stores, gas stations, malls and convenient stores. So far, twelve states have banned the sale of Synthetic Marijuana - (Kansas, Georgia, Alabama, Tennessee, Missouri, Louisiana, Mississippi, Arkansas, Oregon, Illinois, Michigan, and Kentucky). Secretary of State Clinton says Drug Legalization Likely Not to Happen Because "There’s ‘too much money in it."

US Secretary of State, Hillary Clinton believes that the United States would have a hard time legalizing drugs as a means of fighting the black market because "there is just too much money in it." In an interview with Mexican television regarding drug legalization Clinton responded, "You can legalize small amounts for possession, but those who are making so much money selling, they have to be stopped. They can’t be given an even easier road to take, because they will then find it in their interest to addict even more young people." Advocates of legalization have roared back and responded by saying, "Clinton's response illustrates not only the intellectual bankruptcy of the prohibitionist position but the economic ignorance of a woman who would be president." At the Drug War Chronicle, Scott Morgan called Clinton's argument "perfectly incoherent" and argued it flew in the face of economic theory.

Earlier in the year MMC posted a blog titled "California Looks To Marijuana For Bail Out" in which California contemplated legislation to tax and regulate marijuana like it does alcohol to boost tax revenue. The bill would have allowed adults to legally possess, grow and sell marijuana. Officials that are for the tax and legalization of marijuana, believe that it would generate nearly $1.4 billion in revenue. The California State Board of Equalization reported that marijuana retail sales would bring an estimated $990 million from a $50-per-ounce fee and $392 million in sales taxes.

The interview with Secretary of State, Hillary Clinton focused mainly on Mexico's drug war, which has cost over 30,000 lives. Former Mexican President Vicente Fox has come out in favor of legalizing drugs as a way of taking the steam out of organized crime. Mexican President Calderon has approved legislation decriminalizing possession of small amounts of most recreational drugs, and has called for a debate on new approaches to dealing with drugs.

Claims of NFL Players Being Alerted to Drug Testing Shadows Greenbay Packers Superbowl Victory

Media outlets are claiming that NFL players are being alerted to their scheduled drug testing making the drug testing policies and procedures ineffective. The Wall Street Journal (WSJ) claims that Packers head trainer Pepper Burruss alerted Scott Wells after Green Bay's wild-card victory against Philadelphia that the center would be expected in the following day for a drug test. There are two different opposing views - The NFL and The International Doping Community - on letting players know that they will be tested.

The NFL accepts the action of giving advance notice of a test on a game day. Adolpho Birch, the NFL's vice president of law and labor policy, said teams are only allowed to give advance notice of a test on a game day because players are often given the following day off. The league's policy states that if a player is notified but fails to show, he could be subject to NFL discipline. Tests are not given on game day because of logistical complications with traveling and other issues.

David Howman, director general of the World Anti-Doping Agency, which oversees drug testing in all Olympic sports, told the WSJ. "If you're going to do advanced warning, you might as well not test," "Half an hour is a lot of warning. That's how quickly you can manipulate the tests." Travis Tygart, head of the U.S. Anti-Doping Agency, who provided an interview to the Wall Street Journal said, "It's obviously concerning," and "The world knows you can't give advanced notice for testing for it to be effective."

Channel 10 news out of St. Petersburg, Florida is reporting that Florida is implementing "No Refusal" checkpoints for the upcoming New Years Eve celebration. A "No Refusal" means that if you refuse a breath alcohol test during a traffic stop you will be issued a warrant by an on-site presiding judge that will allow police to perform a mandatory alcohol blood test.
There are two sides to ever story so here are the prevailing arguments for and against the mandatory DUI checkpoints:

CON: Keving Hayslett, a DUI defense attorney believes that the the mandatory blood test as a violation of constitutional rights. Hayslett continued his argument by saying, "It's a slippery slope and it's got to stop somewhere." Clinical trials have shown Vivitrol to be effective in preventing not only relapse to drug use following detoxification, but also to diminish cravings that often drive it. Marijuana Smoking Increases as Binge Drinking Slows Among U.S. Teens

The federal government recently issued the results of their annual drug abuse survey in which they concluded that U.S. teens are gravitating more towards smoking marijuana than cigarettes and fewer are binge-drinking.

Government Survey Data

The survey of 46,482 students from 396 schools found that 16 percent of eighth-graders, typically 13 and 14 years old, admitted to using marijuana, up from 14.5 percent in 2009.
More than 21 percent of high school seniors, aged 17 and 18, said they had used marijuana in the past 30 days, while 19.2 percent said they smoked cigarettes. This is the first time marijuana use has passed cigarette use in the survey.
About 23 percent of high school seniors admitted to binge drinking in the past two weeks, compared to 25 percent in 2009 and 31.5 percent in 1998.
The survey found more than 6 percent of high school seniors use marijuana every day, up from 5 percent last year. More than 3 percent of 10th graders and 1 percent of eighth graders said they used marijuana daily, all increases over 2009.

Gil Kerlikowske, Director of the White House Office of National Drug Control Policy said,"Mixed messages about drug legalization, particularly marijuana, may be to blame. Such messages certainly don't help parents who are trying to prevent kids from using drugs."

2009 SAMHSA Report Has 20% of U.S. Adults as Mentally Ill

A recent SAMHSA report concluded that nearly 20% of U.S. Adults had some form of mental illness in 2009 - with 11 million having severe illnesses. The SAMHSA report stated that, "Young adults aged 18 to 25 had the highest level of mental illness at 30 percent, while those aged 50 and older had the lowest, with 13.7 percent."

The survey results gravitate towards the impact of record unemployment rates, which last year hit a 25-year high as struggling employers slashed jobs to cope with a weak economy. The chain of events starts with loss of employment and then loss of health insurance, leaving many unable to get treatment.

Pamela Hyde, SAMHSA's administrator said, "The consequences for individuals, families and communities can be devastating. If left untreated mental illnesses can result in disability, substance abuse, suicides, lost productivity, and family discord."

Arizona Passes Medical Marijuana Act

Arizona became the 15th state in the nation to legalize medical marijuana by approving Proposition 203, which legalizes marijuana for medical use. Under the measure, physicians can prescribe marijuana for patients with "debilitating medical conditions, including cancer, glaucoma, HIV/AIDS, hepatitis C and Alzheimer's disease." Patients, who will be required to register with the state health department, will be able to purchase up to two-and-a-half ounces of marijuana every two weeks at licensed dispensaries, or to cultivate their own plants if they live too far away from approved outlets.

Yesterday, California citizens voted down Proposition 19. Yahoo News reported that if passed Prop 19 would have allowed adults 21 and over to possess up to an ounce of pot, consume it in nonpublic places as long as no children were present, and grow it in small private plots. It also would have authorized local governments to permit commercial pot cultivation, as well as the sale and use of marijuana at licensed establishments.

White House Drug Policy Director Gil Kerlikowske said, "Today, Californians recognized that legalizing marijuana will not make our citizens healthier, solve California's budget crisis, or reduce drug related violence in Mexico.

Even if Proposition 19 passed, federal authorities would have fought against it claiming federal jurisdiction.

The professor concluded, "When drunk in excess, alcohol damages nearly all organ systems. Changes to 49 CFR Part 40, Procedures for Transportation Workplace Drug and Alcohol Testing Programs Effective October 1, 2010

Drug Testing Industry Alert!

Introduction
The Omnibus Transportation Employees Testing Act (Omnibus Act) requires the Department of Transportation (DOT) to follow Department of Health and Human Services (DHHS) requirements for testing procedures/protocols and drugs. Most of the changes to 49 CFR Part 40 were made to meet specific DHHS guidelines for laboratory procedures, drug cut-off levels, and drugs. These guidelines apply to federal employees and employees in federally regulated industries, such as transportation and nuclear, as well as state regulations that mandate compliance with DHHS guidelines.

Changes
On October 1, 2010, The following changes to the DHHS and DOT drug testing panel will be required:

Amphetamines
§ Decrease the Amphetamines screening cutoff from 1000 ng/mL to 500 ng/mL;

§ Decrease the confirmation cutoff of both amphetamine and methamphetamine from 500 ng/mL to 250 ng/mL;

§ Only MDMA is added as a specific target drug for screening; MDMA, MDA and MDEA are included in confirmation testing.

Testing for MDMA (Ecstasy)
MDMA will be a target analyte in the amphetamines screening assay, with confirmation testing for MDMA, MDA, and MDEA.

6-Monoacetylmorphine (heroin metabolite)
§ Addition of a specific screening test for the heroin metabolite at 10 ng/mL cutoff concentration. This change requires a laboratory to confirm and report the heroin metabolite by itself, in contrast to the current Guidelines policy that requires the heroin metabolite to be tested and reported in conjunction with a positive morphine result. Recent data indicates that the heroin metabolite is present in
specimens even when the morphine concentration is below 2000 ng/mL.

Cocaine
§ Decrease the Cocaine metabolite screening cutoff from 300 ng/mL to 150 ng/mL

§ Decrease the Cocaine metabolite confirmation cutoff from 150ng/mL to 100ng/mL

How Will These Changes Affect You?
Although Non-DOT regulated testing programs are not required to implement these upcoming changes (except where required by law),

Industry consensus is that most non-DOT regulated program owners and employers will most likely make changes to follow the new

guidelines. As the new revisions will take effect soon you may need to consider a few issues regarding drug testing program.

The Michigan House of Representatives recently introduced a bill that would allow police to conduct roadside drug testing for reasonable cause. Rick Jones a Representative of the state legislature and former county sheriff stated that, "Police could know within minutes whether a driver is high on drugs."

U.S.Secretary of Transportation LaHood said that, “Drunk driving is deadly, it’s against the law, and unfortunately, it’s still a problem.” LaHood concluded, “With the help of law enforcement around the country, we are going to continue doing all that we can to stop drunk driving and the needless tragedies that result from this reckless behavior.”
One Out of Five Are Drinker-Drivers
According to The National Highway Traffic Safety Administration - Twenty percent of the public 16 and older had in the past year driven a motor vehicle within two hours of drinking alcohol. About two-thirds of these, or 13% of the total population 16 and older had done so in the past 30 days. The survey produced an estimate of 85.5 million past-month drinking-driving trips, up from 73.7 million trips in 2004 and reversing a declining trend in such trips since 1995. More than three-fourths (78%) of the trips were made by males.

Enforcement of Laws
About 1% of the population 16 and older had been arrested for a drinking and driving violation in the past two years; the percentage was 5% for males 21 to 24. Almost three-fourths of the public believed that drivers who had too much to drink to drive safely would be somewhat likely (40%), very likely (21%), or almost certain (12%) to be stopped by police.

The policy group found that during that decade there was a 400% increase in the number of people admitted for treatment for abusing prescription pain medicine. The PA House Committee on Health and Human Services recently heard testimony from users and advocates of medical marijuana who argue that the drug should be legalized because it is effective in treating pain. the State Attorney General and members of the Senate are not likely to schedule a vote on the bill anytime soon though.

The bill sponsored by Rep. Mark Cohen would authorize the state Department of Health to issue ID cards to patients who have been diagnosed by a physician with a debilitating medical condition, such as cancer or HIV, and whose physician recommended the use of marijuana. Patients under 18 could use marijuana, as well, with the consent of a parent or custodian.

State Attorney General Tom Corbett opposes the bill warning that even the limited legalization of marijuana could compound the dangers that drugs present to society.

Iowa Law Enforcement pulls over Drunk Lawn Mower Rider

The Demoines Register reported that a 28 year old man was pulled over while riding a lawn mover... On the highway! Robert Grimstad was seen swerving all over the road and when police finally caught up to the perpetrator they found his blood alcohol content to be .190. Grimstad's reason for cruising on his mower down highway 17 - he was out collecting cans on the side of the road. Boone County Sheriff Ron Fehr was asked if Grimstad was speeding when he was pulled over and Fehr replied "I don't know, how fast does a lawn mower go?" Fehr stated that "In Iowa, it's illegal to drive any motor vehicle anywhere while intoxicated - he could have been charged while mowing his own lawn." Robert Grimstad had been in trouble with the law before as he has two DUI charges, a public intoxication and a record for driving with a revoked license. By the way average riding mowers can travel between 5 to 7 MPH.

"Per Se" Blood Alcohol Concentration (BAC) Level - Most states have DUI laws that deem "per se intoxicated" any driver with a blood-alcohol concentration (BAC) at or above .08 percent. Trenton Police Officer Elsie Vega-Medina has been suspended for testing positive for Oxycontin during her latest drug test. The Trentonian reported that the officer was injured a few years ago when she fell from her horse while on mounted patrol.
