Channel 10 news out of St. Petersburg, Florida is reporting that Florida is implementing "No Refusal" checkpoints for the upcoming New Years Eve celebration.  A "No Refusal" means that if you refuse a breath alcohol test during a traffic stop you will be issued a warrant by an on-site presiding judge that will allow police to perform a mandatory alcohol blood test.
There are two sides to ever story so here are the prevailing arguments for and against the mandatory DUI checkpoints:

CON: Keving Hayslett, a DUI defense attorney believes that the the mandatory blood test as a violation of constitutional rights.  Hayslett continued his argument by saying, "It's a slippery slope and it's got to stop somewhere." He concluded, "what other misdemeanor offense do we have in the United States where the government can forcefully put a needle into your arm?"


PRO: Linda Unfried, from Mother's Against Drunk Driving in Hillsborough County thinks that "It's a great deterrent for people," She concluded, "I think you'll see the difference because people will not drink and drive. I truly believe that."

The federal government says Florida has among the highest rates of breathalyzer refusal.  U.S. Transportation Secretary Ray LaHood has recently said he wants to see more states hold similar programs.
