U.S. Airways Express Pilot Doubled As Drug Testing Cheat Entrepreneur

Stephen Sharp, a pilot for US Airways Express pleaded guilty to selling an adulterant that would help users pass federal drug tests. The product creatively named " Yourintheclear " consisted of a powder that was mixed with cranberry juice and then ingested which was claimed to have masked drugs. The drink solution was marketed on the Internet towards truck drivers, pilots and train engineers and other safety-sensitive positions. Sharp is looking at a sentence of up to 5 years in prison. Candidate for U.S. Congress Wants Drug Testing for College Students

The St. Louis Globe-Democrat is reporting that Bill Haas out of Missouri who is looking to make his mark on the U.S. legislature said that he would like to see colleges randomly drug test their students for the illegal use of the prescription drug Adderall. Adderall is a highly addictive schedule II Narcotic that is frequently prescribed for treating attention deficit disorder (ADD). College students who do not have ADD are taking the drug illegally to help them focus during exam preparation. A study by the University of Kentucky reported that 34 percent to 60 percent of undergraduates use Adderall or similar drugs. Of those students, 97 percent use them illegally to improve their grades. The study cited that students said they thought using the drug had improved their grades by one to two letter grades. UPDATE - 49 Code of Federal Regulations (CFR) Part 40: Mandatory Guidelines for Federal Workplace Drug Testing Programs Extended to October 2010

The Federal Government has pushed its deadline for Mandatory Guidelines for Federal Workplace Drug Testing Programs from May 1, 2010, to October 1, 2010. (49 Code of Federal Regulations (CFR) Part 40). The Fed's reason for the delay is to alleviate the direct expenses it would take for participants to comply with the May 1, 2010 date. Oregon Rules For Employers In Case of Positive Marijuana Drug Test Despite Medical Marijuana Card

The Oregon Supreme Court ruled that employers can fire employees whose drug test comes back positive for marijuana even if the employee has a medical marijuana card. The decision is based on a 1998 state law that gives way to federal law in the case of marijuana. The gist of the Federal law is that marijuana is an illegal drug and it has no medicinal purpose. State Justice Rives Kistler stated, "Because employee did not take marijuana under supervision of a licensed health care professional and because the authorization to use marijuana found (in state law) is unenforceable, it follows that employee was currently engaged in the illegal use of drugs." Medical Marijuana being legal in 13 States and a half dozen more considering the issue.
